TERMS AND CONDITIONS FOR BOOKING WITH KOMPAS EXPRESS

THE FOLLOWING TERMS AND CONDITIONS APPLY TO ALL BOOKINGS MADE WITH KOMPAS EXPRESS (ONLINE AND NON-ONLINE). PLEASE READ CAREFULLY AND UNDERSTAND  BEFORE MAKING A BOOKING WITH KOMPAS EXPRESS. HOTEL BOOKINGS

Rate Conditions and Cancellation Policies: Disclosure and Acceptance of Purchaser

Disclosure: Disclosure of applicable hotel rate conditions and cancellation policies is made available at time of purchase (before placing an order) as follows:

For online bookings made through Kompas.Express disclosure is to be found by clicking on ‘RATE DETAIL’, during the rate selection process.

For non-online bookings disclosure is to be found on written communications between the purchaser and Kompas Express personnel and/or on Kompas Express’ invoices or other similar documents.

Acceptance of Purchaser: Placing an order implies that the purchaser has read and agreed with the applicable hotel rate conditions and cancellation penalties.

AIR BOOKINGS

Rate Conditions and Cancellation Policies: Disclosure and Acceptance of Purchaser

Disclosure: Disclosure of applicable air rate conditions, routings, connections, change and cancellation policies is made available at time of purchase (before placing an order) as follows:

For online bookings made through Kompas.Express disclosure is to be found by clicking on ‘FARE RULES’, during the rate selection process. When booking one itinerary on multiple airlines it is possible you are purchasing more than one air ticket, as shown online. In such cases be advised that connections are never guaranteed and the delayed operation of one flight may result in extra charges payable by the purchaser.

TRIP PLANNING FEES

Trip Planning Fees Conditions and Cancellation Policies: Disclosure and Acceptance of Purchaser

Disclosure: Disclosure of applicable trip planning fees conditions and cancellation policies is made available at time of purchase (before placing an order) as follows:

Professional Consultation/Planning (C/P) fees are in Canadian Dollars and are subject to 13% HST. C/P fees are non-refundable and payable in advance. Days of travel are calculated as days at destination. For the purposes of planning, ‘Hotel Bookings’, ‘Transport Bookings’, ‘Tour Bookings’ and ‘Activity Bookings’ mean: ‘Booking on your behalf and at your expense’. Minimum planning charge $100.

Acceptance of Purchaser: Placing an order implies that the purchaser has read and agreed with the applicable trip planning fees rate conditions and cancellation penalties.

PACKAGED HOLIDAY BOOKINGS

Cancellation Policies: Disclosure and Acceptance of Purchaser

In some cases, when the booking process is manually assisted, travel services could be offered for one total trip price, without discrimination of costs for each individual component. Such cases are defined as ‘Packaged Holiday Bookings’. When this occurs, the disclosure of this status will be clearly made at time of purchase in writing correspondence between Kompas Express and the purchaser. Terms of payment will be indicated in the same correspondence.

Cancellations for all disclosed ‘Packaged Holiday Bookings’ as defined above, must be advised in writing and are subject to these terms: If the notification is received 45 or more days prior to the date of departure, fees will be determined solely based on several components of the package, such as (but not limited to): non-refundable supplier fees applicable at time of cancellation. If the notification is received 44 to 21 days prior to the date of departure, the fee will be equivalent to 50% of the global (total) trip price. If the notification is received 20 days or less prior to the date of departure, the fee will be equivalent to 100% of the global (total) trip price. notification shall be deemed to have taken place on the date of receipt of such notification by Kompas Express.

Acceptance of Purchaser: Placing an order implies that the purchaser has read and accepted the cancellation terms as defined in the previous paragraph.

ADDITIONAL ADMINISTRATIVE CHARGES APPLY FOR REVISIONS, CHANGES AND CANCELLATIONS - READ BELOW

 

ADDITIONAL ADMINISTRATIVE CHARGES FOR REVISIONS, CHANGES, CANCELLATIONS

 

Non-waivable administrative charges will be imposed on all revisions, changes or cancellations made to paid bookings to offset our costs. These charges are extra and are in addition to fees and penalties applied by suppliers (such as hotels and airlines, for example) and any price increase. Revisions and changes are subject to availability. Our minimum administrative charge per service is CAD $75 + 13% H.S.T.

As displayed above, or by written communications between the purchaser and Kompas Express personnel and/or on Kompas Express’ invoices or other similar documents if the charge exceeds our minimum.

Acceptance of Purchaser: Placing an order implies that the purchaser has read and accepts non-waivable administrative charges in case of revisions, changes or cancellation.


Note that unsubstantiated or unreasonable credit card disputes and/or chargebacks are also subject to administrative charges, the minimum amount of which is CAD $75 + 13% HST.

 

DEFINITIONS AND YOUR RESPONSIBILITIES

 

Definitions:  In these Terms and Conditions, "Kompas Express", "the Company," "we," and "us" means Kompas Express Travel, whose principal office is at 741 Bloor Street West, Toronto, Ontario, Canada. These Terms and Conditions, the information on our website and any acceptance of your booking by the Company, form the sole basis of the contract between you and us. Your contract is governed exclusively by the laws of the Province of Ontario.  Courts shall have exclusive jurisdiction to determine any dispute or claim that arises out of or in connection with the contract. These Terms and Conditions apply equally to you and to all persons named in your reservation. When you make your booking, you guarantee that you have the authority to accept and do accept on behalf of your party these Terms and Conditions.

Your Responsibilities: you must ensure that you and all members of your party have valid passports, visas, certificates of vaccination, and any other documents required to enter any country you are visiting, including transit stops, prior to your departure. We cannot accept responsibility for any failure to comply resulting in any costs or fines being incurred, and we advise you to check with the appropriate passport office(s) or consulate(s)  if you have any questions. We shall not be liable for any changes to or cancellation of your stay due to events beyond our control. Examples of events beyond our control include, but are not limited to, force majeure; war or threat of war; riot or civil disturbance; political unrest; terrorist activity or threatened terrorist activity; pandemics; propagation of viral diseases; industrial disputes or threatened industrial disputes; strikes, fire, floods, or other natural disasters; nuclear disasters; adverse weather conditions; acts of God; acts of government; travel advisories; closure of airports; or failure of a carrier, hotelier, or other person to operate services for any reason.  For your own protection, we strongly recommend that you and all members of your party have comprehensive travel and medical insurance for the full duration of your trip. It is your responsibility to ensure that the insurance policy you purchase is suitable and adequate for your particular needs.


Although Kompas Express has made every effort to ensure that the information, pricing and photographs contained in our proposals are accurate, the occasional error or change in circumstances may occur. Inclusions may be varied or withdrawn with or without prior notice. Kompas Express reserves the right to correct and update this site as consequence of any errors or omissions and to amend these Terms and Conditions at any time as a result of any material changes to legislation, regulation or other circumstances.

 

CHANGES TO YOUR BOOKING(S)

 

Changes made by you: If you wish to change your reservation in any way, we will endeavor to accommodate these changes, but it may not always be possible to do so. All changes are subject to availability. Any request for changes must be made in writing by the lead person on the reservation. Changes are subject to administrative charges as defined in these terms and conditions. You will also be required to pay any increase in the cost of your reservation as a result of your changes. Separate cancellation charges may be applicable for certain arrangements during peak and non-peak periods. Changes made by us: It is unlikely that we will need to make any alteration to your travel arrangements, but sometimes circumstances change and alterations have to be made. We reserve the right to change your reservation at any time. If we make a major change, we will advise the lead person on the reservation as soon as reasonably possible. A major change is one that we make to your arrangements before your departure that affects an essential term of your contract. Example of major changes includes (but is not limited to): a change of accommodation to that of a lower official classification for the whole or a major part of your stay. If we make a major change, we will offer you a choice of the following options: (1) accept the changed arrangements, or (2) accept substitute arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value), or (3) cancel your reservation and receiving a full refund of all monies paid to us for it. You must tell us which of the above choices you wish to make within 48 hours of being informed of the major change we are making. If we do not receive notification from you about your choice within 48 hours, you are deemed to have accepted the option offered.

 

PAYMENTS AND CREDIT CARDS

 

Payments must be made by credit card. Some payments made by credit card may incur in surcharges. Disputes are subject to administrative charges.

 

REFUNDS AND CREDIT NOTES

 

No refund will be made for any part of your reservation that is not utilized (e.g., extra nights, breakfast, activities, or other services). If, for other reasons, a refund is to be requested, such request must be submitted no later than 30 days from the original start of services date. Note that eventual refunds for credit card payments may take up to 45 days. We reserve the right to offer credit notes valid for future travel in lieu of cash refunds at any time. Such credit note shall be construed as postponment to a future date of the service to be rendered.

 

PRICES

 

The price of any stay includes only the items specified in your reservation. Unless otherwise specified, it does not include items of a personal nature, including, but not limited to, travel insurance, meals, optional excursions, passport, visas, cots and food for infants, laundry, room service, mini-bar and hotel extras (including early/late check-in/check-out fees), hotel car parking (where applicable) or gratuities.

Price increases due to currency fluctuations: Kompas Express reserves the right to increase the prices of travel services sold, if necessary due to currency fluctuations. If the increase is higher than 7% of the published price including hotel taxes and service charges, the purchaser may cancel his/her holiday and receive a full refund, except if the price increase is a result of increased government taxes.

 

HOTEL CHECK-IN/CHECK-OUT TIMES

 

Unless otherwise specified, the check-in time at all hotels booked on this website is 2PM (14.00hrs) on the day of arrival you have selected. Check-out time at all hotels booked on this website is 11AM (11.00hrs) on the day of departure you have selected. The hotels booked on this website do not offer 24hr check-in facilities and early/late check-in/check-out fees apply (payable locally and subject to availability), in most cases equivalent to one-night stay at regular rate.

 

MINIMUM AGE REQUIREMENTS TO BOOK HOTELS

 

The lead person on the booking must be at least 21 years old.

 

AVAILABILITY OF HOTELS

 

All featured hotels and services are subject to availability.

 

SERVICE VOUCHERS FOR HOTELS AND LAND SERVICES

 

Valid service vouchers are always required by hotels and transport/tour providers. It is important to check your vouchers to make sure that all the details are exactly as you requested. In the event of any discrepancy, please contact us immediately, as it may not be possible to make changes later.

 

HOTEL STANDARDS ABROAD

 

Guests should be aware that hotels and services vary according to different living standards in various countries. Hotels are classified by industry standards and local government ratings. Kompas Express reserves the right to make substitutions with hotels of similar or higher ratings. Special requests made for particular hotel rooms, room location, bed types etc., are solely at the discretion of the hotelier or contractor. Kompas Express will not be liable for any failure to accommodate or fulfill such requests.

 

LOCAL CITY TAXES PAYABLE AT HOTELS


Local city taxes are NOT included in any Kompas Express pricing and must be paid locally at each hotel. City taxes are subject to change at any time.

 

 

SPECIAL REQUIREMENTS

 

Any special requirements must be disclosed to Kompas Express at the time of booking. Kompas Express will use reasonable efforts to accommodate special requirements or requests, but this is not always possible given the nature of the destinations visited. Certain activities may be inaccessible if mobility is limited in any way. All food allergies and dietary restrictions must be disclosed at the time of booking, but Kompas Express cannot guarantee that dietary needs or restrictions can be accommodated and will not be liable for any failure to accommodate or fulfill such requests.

 

MISSED PICK-UPS

 

No refunds on missed transfers or tours. Please carefully indicate the time you want to be picked up (start time) as that is the time our driver will be at the specified point. Allow sufficient time prior or after your flight, in calculating pick-up and drop-off times at Airports. We recommend allowing a minimum of one hour after arrival of your flight for airport pick-up and a minimum of three hours before your flight departure for hotel pick-up.

 

PRIVACY AND DATA PROTECTION

 

Kompas Express respects privacy and is committed to protecting it. Please refer to our PRIVACY POLICY. In general, we collect and use data relating to travelers in order to deal with queries or to complete travel arrangements. This personal data will include clients’ name, date of birth, contact details and credit card details. We use the requested personal data to create the clients booking and process their payment. Where relevant for the client’s booking, we may disclose the clients’ personal data to other organizations, such as tour suppliers, transport providers, and hotels. Credit card information, as required by credit card companies is used internally only for payment processing and we are committed to fraud prevention. We only accept credit card information submitted by secure payment link sent by us.
